The type of personal information we collect

We currently collect and process the following information:

  • Enquirers name, email address and phone number

  • Client name, address, email address and phone number

  • Client access requirements if necessary for the design of a garden

 

How we get the personal information and why we have it

Most of the personal information we process is provided to us directly by you for one of the following reasons:

  • So that we can provide information about what Ammil Garden Design does so that enquirers can decide if they would like to engage a designer.

  • In order to undertake the design process once engaged by a client.  

We use the information that you have given us in order to communicate with you about your potential or ongoing garden design projects.

We may share this information with landscaping contractors or other specialists if required to draw up designs or if you engage us to carry out a tender process.   

Under the UK General Data Protection Regulation (UK GDPR), the lawful bases we rely on for processing this information are:

1.     We have a contractual obligation – in the case of clients who have engaged us to design a garden/give a consultation.

2.     We have a legitimate interest – in the case of contacting a potential client who has expressed interest.

 

How we store your personal information

Your information is securely stored.

We keep data for the following time periods:

  • Names and contact details for enquirers who do not chose to engage us for a design are kept for 3 months then permanently deleted.

  • Names and address of clients are kept indefinitely alongside their garden design plans in case of any future queries or disputes relating to that design.

  • Email addresses and phone numbers for clients are kept for a minimum of 5 years and then the need to keep these for any further time will be assessed on a case by case basis. If no longer needed the data will be permanently deleted.

  • Client access requirements necessary for the design of a garden - references on any plans/briefs will be kept indefinitely (e.g. path width appropriate for a wheelchair). Any extraneous information (e.g. elaboration on why a wheelchair is used) will be permanently deleted at the end of the project.

 

Your data protection rights

Under data protection law, you have rights including:

Your right of access - You have the right to ask us for copies of your personal information.

Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.

Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.

Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances.

Your right to object to processing (in the case of legitimate interest but not contract) - You have the the right to object to the processing of your personal information in certain circumstances.

Your right to data portability (in the case of contract but not legitimate interest) - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.
